Welcome to Saugeen Drives. These Terms and Conditions (“Terms”) govern your access to and use of our mobile applications, website, and all related services (collectively, the “Platform”). By accessing or using our Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

User Eligibility Requirements
To use the Saugeen Drives platform:

  • You must be at least 18 years of age.
  • You must hold a valid driver’s license if registering as a driver.
  • Customers must provide accurate personal details including a working mobile number and email.
  • Drivers must comply with CRA regulations including incorporation and HST registration.
    By registering, you confirm that you meet all applicable eligibility requirements.

Account Registration and Responsibilities
Users must register by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

  • Notify us immediately of any unauthorized use.
  • Keep your profile updated with accurate personal and vehicle information (drivers).
    We reserve the right to suspend or terminate accounts for any breach of these terms.

Permitted and Prohibited Use
Permitted:

  • Booking rides as a customer.
  • Accepting rides as an approved driver.
  • Using features like live tracking, chat, and SOS for genuine purposes.

Prohibited:

  • Misusing the platform to harass, impersonate, or defraud.
  • Reverse engineering the mobile apps.
  • Attempting to bypass security features or abuse promo codes.

Pricing, Payments, and Promotions

  • All fares are estimated based on selected category and distance.
  • Final fare may differ due to real-time travel conditions.
  • Card payments are securely processed via Elavon.
  • Promo codes are subject to eligibility and may not be combined.
    Failure to make payment (in case of cash) may lead to suspension of account.

Driver Duties and Responsibilities
Drivers must:

  • Register their corporation and obtain an HST number.
  • Submit all required documents (license, insurance, vehicle registration, police clearance, etc.).
  • Maintain safe driving practices and professional conduct.
  • Keep their app active and share real-time location when online.
  • Accurately record and report received payments.

Customer Expectations and Conduct
Customers must:

  • Provide correct pickup and drop-off locations.
  • Be ready at pickup point when the driver arrives.
  • Avoid abusive language or behavior towards drivers.
  • Report issues promptly via in-app support or SOS.

Background Location Access Justification
Saugeen Drives uses background location:

  • To show real-time driver location to customers.
  • To dispatch ride requests based on driver proximity.
  • To assist during SOS emergencies triggered by customers.
    This access ensures a safe and efficient ride experience for all users.

Cancellation and Refund Guidelines

  • Cancellations made by customers before the driver starts driving may be refunded.
  • No refunds for no-shows or cancellations after driver has departed.
  • Promo code discounts are not refunded once a ride begins.
  • In case of technical errors, users may contact support for dispute resolution.

Privacy and Use of Personal Data
We collect and use your personal data (name, email, phone number, location) to:

  • Facilitate ride bookings and tracking.
  • Contact you regarding service updates or issues.
  • Improve platform functionality and customer support.

Intellectual Property Rights
All content on the Saugeen Drives platform, including logos, designs, and code, is owned by Saugeen Drives or its licensors.

  • You may not copy, modify, distribute, or reverse-engineer any part of the platform without prior written consent.

Limitations of Liability
Saugeen Drives is not liable for:

  • Delays, accidents, or losses arising during rides.
  • Driver or customer misconduct.
  • Technical failures or force majeure.
    Our liability is limited to the maximum extent permitted by applicable law.

Dispute Handling and Resolution
In case of a dispute:

  • Contact our support team first to resolve the issue amicably.
  • For unresolved matters, arbitration may be used before legal steps.
  • Both parties agree to resolve disputes in Ontario, Canada jurisdiction.

Changes to Terms and Conditions
We may revise these Terms at any time. Updated terms will be posted on our website. Continued use of the platform after changes means you accept the revised terms.
